When an individual dies, succession is the universal method of transferring property to the legal successors—heirs. Only the estate of individuals is heritable. Slovak law recognises intestate and testate succession.

Who is a participant in succession proceedings?  

The legal heirs; if there are no legal heirs, the estate passes to the state by default.

Can I select my own notary/court commissioner to conduct my succession proceedings?

No. Participants in succession proceedings are not allowed to select their own notary/court commissioner because the notary is appointed by the court of competent jurisdiction. The presidents of the district courts are authorised to appoint the notary according to their case schedule.

The Registry Office notifies the competent court of the death in the registry district, usually by submitting a death certificate.

Who conducts succession proceedings?

Succession proceedings are conducted by a notary who acts in the capacity of court commissioner by appointment of the competent court.

How can a court rule in an inheritance resolution?

  • to confirm a single beneficiary of the estate
  • to confirm that the estate passes to the state where no beneficiary inherited
  • to approve a settlement agreement between the heirs; the deceased’s creditors are party to the agreement if the debts are settled from the estate
  • to approve an agreement to pass on overindebted estates for payment of debts
  • to confirm succession according to the lawful share of inheritance where the participants cannot reach an agreement, or to implement a settlement between the heirs and decide what each heir will inherit
  • to reject the settlement agreement and confirm succession according to the lawful share of inheritance, or to implement a settlement between the heirs and decide what each heir will inherit
